This Rental Agreement is between Photo Genius (the “Studio”) and the renter named in the request (the “Renter”) for reservation assigned after submission.

2. Collection and condition
The Renter must inspect the items at collection and promptly identify any existing damage, missing component or material defect. The Studio may record item identifiers, condition notes and photographs at collection and return. Acceptance at collection confirms that the items were received in the recorded condition, subject to a defect that could not reasonably have been identified during inspection.
3. Permitted use and care
The Renter must use the items carefully, lawfully and only for their intended purpose; follow any operating, fitting, cleaning and safety instructions; keep them secure, dry and protected from excessive heat, dust, smoke, liquids and unauthorised handling; and not sell, pledge, sublet, lend, alter, repair or remove identifying marks without the Studio’s prior written approval.
Dresses, fabrics, props and backgrounds may not be cut, permanently altered, dyed, glued, pinned in a damaging manner or cleaned using an unapproved method. Equipment may not be opened, modified or serviced by the Renter.
4. Return and extensions
The Renter must return every item, accessory, case, battery, charger, cable, garment and component to 130 St Georges Road, Observatory, Johannesburg by the agreed return time. An extension is valid only when approved by the Studio in writing before the original deadline. Continued possession without approval does not extend the agreement.
Late return may result in reasonable additional rental and recovery costs reflecting the delay and its effect on other reservations. The Studio will communicate any assessed amount and supporting basis to the Renter.
5. Damage, cleaning and incomplete returns
The Renter is responsible for loss or physical damage occurring while the items are in the Renter’s possession or control, except to the extent caused by an inherent defect, ordinary wear from proper use, or the Studio’s prohibited conduct. The Renter must report any accident, damage or malfunction immediately and stop using an item when continued use may worsen the damage or create a safety risk.
The Studio may charge the reasonable, documented cost of specialist cleaning, repair, replacement parts, diminished value where properly supported, and associated recovery directly caused by the breach. No charge will be duplicated, arbitrary or greater than the reasonable loss suffered.
6. Lost, stolen, missing or unreturned items
The Renter must notify the Studio immediately if an item is lost, stolen, missing or cannot be returned on time. For suspected theft, the Renter must reasonably assist with a police report and provide the case number and relevant information. Reporting theft does not by itself remove responsibility under this agreement.
If an item is not returned, the Studio may require its return and may claim reasonable recovery costs and the reasonable replacement value of an equivalent item, less any amount recovered or avoided. Ownership does not transfer merely because a replacement amount is charged.
7. Security deposit and outstanding amounts
The security deposit may be held until the return inspection is complete. The Studio may apply all or part of it to a documented amount due under this agreement and will provide the Renter with the reason and calculation. Any unused balance will be returned. If the reasonable amount due exceeds the deposit, the Renter remains responsible for the balance after receiving a written assessment.
8. Cancellation, breach and recovery
Cancellation and date changes remain subject to the policy shown during reservation and the Consumer Protection Act where applicable. A serious breach—including unauthorised disposal, refusal to return an item, or conduct creating a material safety or loss risk—allows the Studio to cancel the rental and require immediate return, subject to applicable law. Reasonable recovery or enforcement costs may be claimed only where legally recoverable and properly supported.
9. Responsibility and consumer rights
The Studio will supply the rental service with reasonable care and skill. Nothing in this agreement excludes a right or remedy that may not lawfully be excluded, or liability that the Consumer Protection Act does not permit the Studio to avoid. The Renter remains responsible for supervising the items and for obtaining any insurance appropriate to the intended use.
10. Privacy, electronic acceptance and records
The Studio may process contact details, electronic acceptance records, condition evidence and incident information to administer the rental, protect inventory, communicate with the Renter and establish or defend legal claims, as described in the Privacy Policy. The parties agree that this agreement and operational notices may be created, accepted and delivered electronically.
11. Entire agreement and changes
This agreement, the reservation confirmation, the accepted item schedule and any later written amendment form the rental agreement. If the parties approve a date, item or price change after acceptance, the written confirmation of that change supplements this frozen version. No informal statement changes the agreement unless confirmed in writing.
