PHOTO GENIUS – TERMS OF SERVICE
1. GENERAL AGREEMENT
By booking a photoshoot with Photo Genius (“Studio”), the client (“Client”) agrees to the following terms and conditions. These terms constitute a legally binding contract governing all photography services provided by Photo Genius.
2. BOOKING & PAYMENT
- Clients have the option to pay either a deposit or the full amount at the time of booking.
- A non-refundable deposit or full payment is required to secure a booking. If a deposit is paid, the remaining balance must be settled before the session begins.
- Any booking where payment (deposit or full) is not received within 30 minutes will be automatically canceled, and the time slot will become available for others.
- Prices are subject to change; however, the rate confirmed at the time of booking will be honored.
3. RESCHEDULING & CANCELLATION
Rescheduling
- Clients must notify Photo Genius at least 48 hours in advance to reschedule their session. A rescheduling fee of R300 will apply.
Cancellations & Refunds
- Once proof of payment is received, the booking is confirmed, and cancellations are not allowed. No refunds will be issued.
- Exceptions: If Photo Genius needs to reschedule due to unforeseen circumstances (e.g., illness, emergencies, or equipment failure), the Client will be offered an alternative date or a full refund.
4. IMAGE DELIVERY & TURNAROUND TIME
- A proofing gallery will be provided within 3 business days for the Client to select final images.
- Proofing galleries are for viewing only and may not be downloaded, printed, or shared on social media.
- Additional images can be purchased at R100 per image.
- Final high-resolution, watermark-free images will be delivered within 7 – 10 business days after selections are made.
- Unedited or RAW images will not be provided under any circumstances.
5. COPYRIGHT & USAGE RIGHTS
- All images remain the exclusive intellectual property of Photo Genius.
- Clients are granted a personal-use license to print and share their images for non-commercial purposes only.
- Images may not be altered, resold, distributed, or used for commercial purposes without prior written consent from Photo Genius.
- Clients may share images on social media but must credit and tag Photo Genius where applicable.
6. PROMOTIONAL USE
- By booking with Photo Genius, the Client grants permission for their images to be used for marketing and promotional purposes, including but not limited to portfolios, social media, advertisements, and website content.
- Only first names will be used in promotional materials.
- Clients wishing to opt out of promotional use must submit a written request before the session begins.
7. STUDIO RULES & CLIENT RESPONSIBILITIES
🚫 No personal photography or video recording is allowed during the session. Unauthorized photos will be charged at R650 per image, and videos at R1,000 each.
🚫 No food or drinks are allowed inside the studio.
🚫 Clients must adhere to their scheduled session time.
Arrival Time
- Clients should arrive at least 20 minutes early or 45 minutes early if makeup services are required.
- Sessions start and end exactly at the scheduled time.
- Late arrivals may result in a reduced session duration.
8. LIABILITY WAIVER
- The Client acknowledges that they are participating in the session at their own risk.
- Photo Genius is not responsible for any injuries, damages, theft, or losses incurred before, during, or after the session.
- Clients are responsible for their own safety and that of any accompanying children or guests.
9. FORCE MAJEURE
- Photo Genius is not liable for any delays, cancellations, or service interruptions due to circumstances beyond its control, including but not limited to natural disasters, power outages, government restrictions, or equipment failure.
10. AGREEMENT & ACCEPTANCE
By proceeding with a booking, the Client confirms that they:
✔ Have read, understood, and agreed to all terms outlined in this contract.
✔ Acknowledge that deposits are non-refundable and cancellations will not be reimbursed.
✔ Understand that proofing galleries are for viewing only and may not be printed or shared.
✔ Grant Photo Genius the right to use images for promotional purposes, unless an opt-out request is submitted in writing before the session.
